Terms of Use

This policy governs the use of the Website (www.deanhoweswbp.com), products and services owned and offered by Dean Howes Well-Being & Performance (the School) by users (each, a “Student”) of the School. It applies in conjunction with our Privacy Policy.

Terms

  1. By accessing the School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory use only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials in any way.
  7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by the School at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Refund Policy

  1. For our Coaching products and services:
  2. The refund policy for this product is governed by the Coaching Contract, which is viewable in the Preparing for Coaching free course from the Website;
  3. If the Coach cancels the coaching services, the Client will be granted a full refund for the remaining sessions. If the Client cancels a single session or the remainder of a block booking of sessions, refunds will be granted on the following basis:
  4. The refund request is made within 30 days of payment (by contacting [email protected]);
  5. For a single session product, the coaching session has not taken place;
  6. If the cancelation of a single coaching session is requested at least 48 hours before the scheduled session a 90% refund will be granted (full refund minus administration fees);
  7. If the cancelation of a single coaching session is requested between 48 and 24 hours before the scheduled session a refund of 40% of the purchase price will be granted (inclusive of administration fees);
  8. If the cancelation of a single coaching session is requested within 24 hours of the scheduled session no refund will be granted;
  9. If the cancelation of the remainder of a block booking of five sessions is requested the Client will be granted a refund for the remaining sessions minus 1 session and minus 10% of the purchase price for administration fees. If only 1 session remains in the block, no refund will be granted.
  10. For our Courses products:
  11. A full refund will only be granted upon request to [email protected] within 14 days of purchase under the following conditions:
  12. The Student has not accessed any of the course sections or materials;
  13. The Student has accessed the Introduction section materials but not any other sections or materials.
  14. For our Digital Download products (Downloadable Techniques):
  15. Due to the nature of these products being electronic resources that are accessible to the Student immediately upon purchase and with no method of tracking access:
  16. No refund will be given.

4. Comments and questions

  1. Comments and questions posted within our Courses products will be made visible once they have been approved by the School:
  2. The School reserves the right to display or withhold the display of any comment or question it deems to be inappropriate;
  3. In doing this, the School is acting as the moderator for the comments and questions.
  4. Comments and Questions displayed will be available for comment by the School and by other Students:
  5. The School will endeavour to respond to all comments and questions where appropriate;
  6. Responses from other Students will be moderated by the School.

5. Testimonials

  1. If a Student submits a testimonial for the School they are granting permission for the School to display the message as received on the Website and all other electronic and hard copy promotional material(s).

6. Disclaimer

  1. The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

7. Limitations

  1. In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorised of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Revisions and Errata

  1. The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

  1. The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

10. Site Terms of Use Modifications

  1. The School may revise these Terms of Use at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

11. Governing Law

  1. Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.
